Abstract

Published videos of systems portraying sequences of user interactions can become compelling evidence as prior art supporting invalidity contentions for patents in intellectual property cases. A video illustrating how a system works shows details that may not be revealed in textual descriptions, can be easier for lay people to understand compared to text, and often removes obfuscation. The beauty of a good interaction video is that it is easy to see exactly what a user is doing, and exactly how the interface responds. Thus videos make it far easier for a juror to understand the prior art being presented and whether it is, in fact, good evidence of invalidity.
